The prosecution accepted the accelerated trial request made by the Vergine Oil scandal defendants.
According to the Prosecution, the Court should be the one to confirm it. But the judge panel led by Kreshnik Omari lojra me motorra requested two weeks for consulting and taking a decision, and if they will accept the accelerated trial request or not.
In the third session, the process for the 16 defendants of the Vergine Oil scandal is now on a crossroad, waiting if the trial will be held normally or if it will be accelerated. This request was made by the drivers, who are under indictment for failing to report a crime, and businessman Iliaz Fisheku, accused of money laundering.
The Prosecution pretends that thousands of tons of raw oil have not been exported abroad, as signed on papers, but instead it was sold and mixed with imported oil in Albania.
The Court of First Degree judges are now implementing a Constitutional Court decision, which is equal to the law, regarding the accelerated trial; a decision that is expected to cause dilemmas among them for accepting the accelerated trial or not.
According to this decision, if the accelerated trial will be accepted, the judges will not be able to change the charges during the judicial investigation. Without mentioning the interpretation of the Constitutional Court, many judges declared for Top Channel that the legislative, after this decision, must intervene urgently for reviewing Article 375 of the Penal Procedure, which falls against the Constitutional Court decision taken on February 10th.
